That flexibility can be useful for a family, business succession or wealth management, but it requires real governance and annual tax analysis.<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"color: #000000\">The trust should not be presented as an automatic income-splitting mechanism. Attribution rules, tax on split income, reporting obligations and the 21-year deemed disposition can materially change the result.<\/span><\/p>\n<h2 style=\"text-align: left\"><span style=\"color: #000000\">What trustee discretion actually means<\/span><\/h2>\n<p style=\"text-align: justify\"><span style=\"color: #000000\">Eligible beneficiaries are defined in the deed, but they do not necessarily have a fixed entitlement to a distribution. Trustees must exercise their powers in good faith, in the beneficiaries\u2019 interests and in accordance with the trust\u2019s purpose.<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"color: #000000\">Decisions should not be dictated informally by one person. A resolution should identify the distribution, beneficiary, amount and timing. The bank records, entries and information slips must then match that decision.<\/span><\/p>\n<h2 style=\"text-align: left\"><span style=\"color: #000000\">Review each distribution before year-end<\/span><\/h2>\n<p style=\"text-align: justify\"><span style=\"color: #000000\">Distributing income may allow it to be taxed in a beneficiary\u2019s hands, but the result depends on the income type and the rules applying to that person. A distribution to an adult child, spouse or person connected with the business may be subject to tax on split income.<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"color: #000000\">The attribution rules must also be reviewed when the property or funds originated with a related person. The distribution has to be paid or made payable properly and supported by documentation before the relevant deadlines.<\/span><\/p>\n<h2 style=\"text-align: left\"><span style=\"color: #000000\">Use the trust for succession or family protection<\/span><\/h2>\n<p style=\"text-align: justify\"><span style=\"color: #000000\">After an estate freeze, a trust may hold new growth shares and give trustees flexibility among several beneficiaries. It may also administer property for a minor, a vulnerable person or family members whose needs change over time.<\/span><\/p>\n<p style=\"text-align: justify\"><span style=\"color: #000000\">Flexibility does not replace corporate governance. Voting rights, the shareholder agreement, redemption rules and trustee succession should be coordinated. A trust should not be added to an organization chart without deciding who will make decisions ten or twenty years later.<\/span><\/p>\n<ul style=\"text-align: justify\">\n<li><span style=\"color: #000000\"><strong>Distribution criteria<\/strong> consistent with the deed and beneficiary needs.<\/span><\/li>\n<li><span style=\"color: #000000\"><strong>Trustee independence and succession<\/strong> planned from the start.<\/span><\/li>\n<li><span style=\"color: #000000\"><strong>Interaction with the corporation<\/strong>, dividends and shareholder agreements.<\/span><\/li>\n<li><span style=\"color: #000000\"><strong>A plan before the 21st anniversary<\/strong> for appreciated property.<\/span><\/li>\n<\/ul>\n<h2 style=\"text-align: left\"><span style=\"color: #000000\">Budget for compliance and risk<\/span><\/h2>\n<p style=\"text-align: justify\"><span style=\"color: #000000\">The trust may have to file returns, issue slips and disclose information about people connected with it.
